Summary of Emphri Technologies Inc. Terms of Use and key responsibilities.
1. Relationship between Users: Person Requesting Support and Caregiver
You, the user, acknowledges and agrees that by accessing or using Emphri, and any other products created by Emphri Technologies Inc (the “Company”), however accessed or used:
- If you are a person requesting support (or are their parent or other legal guardian acting on their behalf, if applicable) (“Person Requesting Support”), such access or use creates a relationship between you, and the caregiver (“Caregiver”), their staff and other support organizations (“Staff”);
- Otherwise, if you a Caregiver, or their Staff, such access or use creates a relationship between you, and the Person Requesting Support.
2. Company Not Responsible for Caregiver
The Company does not, and will not be deemed to direct, control, or oversee any users, the Caregiver’s work environment, training provided to a Caregiver (or any of their Staff), or the Caregiver’s performance. In the event that an issue arises between the users, the users’ sole remedy through the Company shall be termination of the applicable service.
3. Caregiver Selection
The Company makes no representation or warranty as to the accuracy of the information provided by the contractor, or about any of the contractor’s skills, experience, background, suitability, or education (including, any licenses).
4. Workplace Environment and Training for Caregiver
You acknowledge and agree that the Company is in no way responsible for the workplace environment or supervision of the Caregiver or the Staff during the provision of services made through any of the Company’s products.
5. No Endorsement as to Accuracy
The Company accepts no responsibility for the accuracy of any data provided by you or created using the product except as otherwise set out in these Terms (defined below). The provision or storage of your user data through the product does not constitute our endorsement or warranty as to the compliance of such data with applicable privacy legislation, nor to the accuracy, timeliness, materiality, completeness, or reliability of such data. You are responsible for ensuring that the information you have entered into our system is accurate, reliable and complete.
